Terms of Service

These terms govern your use of Scroll Theory Forms, a form backend operated by Scroll Theory Media in Ohio, USA. By creating an account or using the service, you agree to them. If you do not agree, do not use the service.

The service

Scroll Theory Forms receives submissions from forms on your own websites, stores them, classifies likely spam, and forwards real submissions to your verified email addresses. Spam is quarantined rather than deleted, so a misclassified message can still be recovered. Features and limits depend on your plan.

Your account

You are responsible for keeping your login credentials secure and for everything that happens under your account. Give accurate information when you sign up, and keep it current. Tell us promptly if you believe your account has been accessed without permission.

Acceptable use

You agree not to use the service to:

• Break the law, or collect data you have no lawful basis to collect.
• Send unsolicited bulk messages, or use it for phishing, fraud, or malware.
• Store or transmit content that is unlawful, infringing, or harmful.
• Probe, overload, disrupt, or attempt to bypass the limits or security of the service.
• Resell or rebrand the service as your own without our written agreement.

We may suspend or remove content or accounts that violate these rules.

Your forms and your visitors

You decide what your forms collect. You are responsible for complying with privacy and data-protection laws that apply to your forms, including telling your visitors how their data is used and obtaining any consent you need. For the data your visitors submit, you are the controller and we act as your processor, as described in our Privacy Policy.

Plans, billing, and cancellation

We offer a free plan and paid plans. Current plans, prices, and limits are shown on the pricing section of our site and may change over time. Paid plans are billed monthly in advance through Stripe.

• You can upgrade, downgrade, or cancel at any time from the billing area. Cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law.
• If you exceed a plan limit, we may pause email notifications for the overage, but we still store your submissions so you do not lose data. Upgrading restores notifications.
• We may change prices with reasonable notice. Changes apply to billing periods after the notice.

Spam handling

Our spam filtering is a best-effort system. We designed it to quarantine rather than delete, so that a real submission flagged as spam is still available to you. We do not guarantee that every spam message is caught or that every legitimate message is delivered without delay. You should review your quarantine periodically.

Availability

We work to keep the service available and reliable, but we do not promise a specific uptime on current plans. The service may be unavailable at times for maintenance, updates, or reasons outside our control.

Disclaimers

The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Scroll Theory Media is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the claim arose.

Indemnification

You agree to defend and hold harmless Scroll Theory Media from claims arising out of your use of the service, the forms you operate, the data you collect, or your breach of these terms.

Termination

You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these terms or use the service in a way that risks harm to others or to the service. On termination, your right to use the service ends, and we will handle your data as described in the Privacy Policy.

Changes to these terms

We may update these terms as the service evolves. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts located in Ohio, unless applicable law requires otherwise.
